All products, services, and digital images are final sale, nonrefundable.
Limit of Liability Should Photographer or his agents or employees be unable to perform any or all of the duties herein described for any reason, including, but not limited to: technical problems or failure, film or digital equipment problems or failure, transportation problems or failure, processing problems or failure, accident or illness of any agent or employee of Photographer, or any other reason or cause whatsoever, then the Client agrees to hold Photographer and his agents and/or employees harmless for any damages, causes of action, or claims arising out of non-performance. The Client agrees that the sole remedy for non-performance of this Contract shall be limited to a refund of any paid monies hereunder.
All photographs taken by Photographer are copyrighted. While prints or digital files may be provided to Client in satisfaction of this Agreement, all negatives or digital files remain the property of Photographer and/or Innamorata Photography. Client agrees to not sell, publish, or commercial use any photograph taken by Photographer without express, written permission from Photographer.
By agreeing to these terms and conditions you agree to the unrestricted use by Photographer and his heirs, successors, assigns, and designees, and those acting with Photographer’s permission and authority, of my name and any and all photographic or other images of my event that Photographer creates or makes, for all purposes, in any form, in conjunction with my own or a fictitious name, and in any and all media, including, without limitation, editorial publication, advertising, stock sale, art, promotion, solicitation, or trade. Client waives any right to inspect or approve the finished images, advertising copy, text, or other printed matter that may be used in conjunction therewith, or to the eventual use that the Images may be applied. Client releases and discharges Photographer and those acting under Photographer’s authority from any and all liabilities, claims and demands arising out of or relating to any blurring, distortion, use in composite form, or alteration whether intentional or otherwise, that may occur or be produced in connection with the Images, or in connection with any processing, alteration, transmission, display, publication or other use of the Images. Client further forever releases and discharges Photographer, his heirs, legal representatives, agents, and assigns, from any and all claims, actions and demands arising out of or in connection with the use of said Images, including without limitation, any and all claims for invasion of privacy and libel.
(Please note that, despite the previous paragraph, we will keep your images private if you let us know in writing that you don't want them used.)
All images which are ordered (negatives and/or digital files) will be archived for a maximum of 90 days after the session date, unordered images are purged 30 days after the ordering.
Innamorata Photography is not responsible for clients failure to download images prior to expiration.
